Terms of Service
Please read these Terms of Service (“Terms”) carefully before using the Bakasana mobile application (“the App”, “Service”) operated by Bakasana (“we”, “us”, “our”).
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
Bakasana is a mobile balance-training application available on iOS and Android. The App provides:
- Guided practice programs (Bakasana, Plank, Shavasana, and Flow)
- A practice timer to track session duration
- Progress tracking with statistics (streaks, totals, personal bests)
- Leaderboard rankings via Apple Game Center (iOS) or Google Play Games (Android)
- Shareable achievement cards
- Optional on-device Practice Timeline capture and timelapse generation
- Optional push notification reminders
- Optional cloud sync of progress data through platform services
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.
3. User Accounts
3.1 Platform Sign-In
The App uses Apple Game Center (iOS) or Google Play Games (Android) for authentication. We do not create or manage separate user accounts. Your platform account is subject to the respective platform’s terms of service.
3.2 Guest Mode
You may use the App without signing in. In Guest Mode, all progress is stored locally on your device. Cloud sync and platform leaderboards are not available. We are not responsible for loss of data stored locally.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble any part of the App.
- Manipulate leaderboard scores, practice data, or any other App data through unauthorized means.
- Use the App for any illegal or unauthorized purpose.
- Interfere with or disrupt the integrity or performance of the App or its associated services.
- Transmit malicious code, viruses, or any harmful content through the feedback mechanism or any other channel.
- Impersonate another person or misrepresent your affiliation with any entity on leaderboards.
5. Intellectual Property
5.1 Ownership
All content, design, graphics, trademarks, logos, and software in the App are owned by Bakasana or its licensors and are protected by intellectual property laws. The “Bakasana” name, logo (white “b” in a black square), mascot, and associated brand elements are our property.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes, subject to these Terms.
5.3 User-Generated Content
Share cards generated by the App contain your practice statistics and App branding. You may share these cards freely. We do not claim ownership of your practice data.
6. Health and Safety Disclaimer
The App is not a medical device and does not provide medical advice. Balance training exercises carry inherent physical risks.
- Consult a physician before beginning any exercise program, especially if you have pre-existing health conditions.
- Practice in a safe environment, free from obstacles and on a stable surface.
- Stop immediately if you feel pain, dizziness, or discomfort.
- The calorie estimates shown on share cards are approximate calculations based on MET values and user-provided body weight. They are not clinically validated and should not be relied upon for dietary or medical decisions.
We are not responsible for any injury or health issue arising from your use of the App or from performing the exercises it describes.
7. Third-Party Services
The App integrates with third-party services including Apple Game Center, Google Play Games, Firebase Analytics, and Firebase Crashlytics. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of these third-party services.
8. Availability and Modifications
- We strive to keep the App available but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
- We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.
- We may release updates that change functionality. Continued use after an update constitutes acceptance of any modified features.
9. Data and Progress
- Cloud-synced progress is stored through Apple Game Center or Google Play Games and is subject to those platforms’ data retention policies.
- Locally stored progress may be lost if you uninstall the App, clear app data, or change devices without cloud sync enabled.
- We make reasonable efforts to ensure data integrity but do not guarantee against data loss. We recommend signing in to enable cloud sync.
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your specific requirements.
- The App will be uninterrupted, timely, secure, or error-free.
- Results obtained from the App will be accurate or reliable.
- Any defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAKASANA, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
Our total aggregate liability for all claims related to the App shall not exceed the amount you paid for the App (if any), or ten US dollars (USD $10), whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Bakasana, its developers, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, violation of these Terms, or infringement of any rights of a third party.
13. Termination
- You may stop using the App at any time by uninstalling it.
- We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.
- Upon termination, your right to use the App ceases immediately. Locally stored data will remain on your device until you delete it.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App operator is established, without regard to conflict-of-law principles. Any disputes arising from these Terms or the App shall be resolved in the competent courts of that jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bakasana regarding the use of the App and supersede any prior agreements.
17. Changes to These Terms
We reserve the right to modify, amend, or replace these Terms unilaterally and at our sole discretion at any time, without your prior consent.
- Updated Terms take effect when published on the Bakasana Terms of Service page. The “Last updated” date at the top indicates the latest revision.
- For material changes, we will make reasonable efforts to notify you through the App, release notes, or other appropriate means.
- For non-material changes (such as clarifications, formatting, or minor updates), updating the published Terms and the “Last updated” date is sufficient notice.
- Continued use of the App after publication of updated Terms constitutes your acceptance of the revised Terms.
- If you do not agree to the updated Terms, you must stop using the App and uninstall it from your device.
